The Bankruptcy Process

  • Attend two credit counseling classes
  • Attend a brief hearing before the bankruptcy trustee

Creditor harassment stops — When you retain our firm, creditors and bill collectors should stop harassing you. Simply refer them to our office.

Foreclosure, repossession, garnishment and collection lawsuits stop — When we file bankruptcy for you, foreclosure actions, repossessions, garnishments and collection actions stop. You can focus on living your real life again.

Notification of creditors — Our firm will notify all your creditors that you have filed bankruptcy. This gives them time to respond and attend the bankruptcy hearing, though in reality, most creditors do not.

Development of a personalized debt relief plan — Zingarelli & Lawrence will examine your debts and your assets to develop a debt relief plan designed to obtain maximum debt relief, while allowing you to keep as much of your property as possible.

Hearing before the bankruptcy trustee — About 30 to 60 days after your filing, a hearing will be scheduled before the bankruptcy trustee. Our firm will represent you at this hearing. Your only responsibility will be to answer a few questions.

In a Chapter 7 bankruptcy, your unsecured debts will be discharged 3½-5 months after the trustee hearing. In a Chapter 13 bankruptcy, your repayment plan should be approved.
